Cleveland Municipal Planning commissioners Tuesday night recommended the city not pursue annexation of about 64.4 acres on Freewill Road and Interstate 75 right of way that included the Prospect Apartments.
Senior Planner Corey Divel said city staff recommended commissioners deny the request for annexation by the property owner. He said the proposed annexation area included 5 parcels and 18 dwelling units.
“Due to the state-mandated moratorium on annexations of residential areas which have been performed at the request of the property owner, the most logical route to make this property contiguous to the existing corporate limits is by extending the current boundary along the Interstate 75 right of way,” he said.
The recommendation to deny was based on comments from Cleveland Utilities, Cleveland City Schools, Cleveland Police Department and 911 Emergency Dispatch.
“911 is against it because it would cause gaps in the service,” he said. “It is confusing for dispatchers if they are not exactly sure which departments to dispatch.”
Dispatchers send both city and county emergency responders when they are unsure if the city or county has jurisdiction in a certain area.
“Patrolling, radio response to calls and other routine police services using city personnel and equipment would be provided,” Divel said. “However, in order to access this property, it would be necessary to enter the unincorporated county before coming back into the city limits, which makes it difficult for 911 to determine the appropriate jurisdiction.”
It would cost Cleveland Utilities $1.2 million to provide sewer service within eight years of annexation.
According to comments from city schools, the area is about .75 miles from the current city limits. It would require bus service with additional fuel costs and add students to Stuart Elementary School. Annexation would add approximately 10 to 11 students to the current enrollment of about 490. The school is currently crowded and transportation services are stretched very thin.
Commissioners approved the following agenda items:
n A request by Clark Taylor and Eric Spencer for preliminary and final site plan approval of T&S Townhomes located on 6.18 acres along 19th Street N.W., Clingan Drive N.W., Wynwood Drive N.W. and 20th Street N.W. The property is zoned R3.
n A request by Michael J. Shaver for preliminary approval Lynndale Park, lot 38. The property is located on .34 acres along Key Street N.W. and Travis Street N.W. The property is zoned R3.
